TERMS OF SERVICE

1. Who runs this
This website () is operated by [PENDIENTE: full legal name of the operator], tax ID [PENDIENTE: NIF/CIF], registered address [PENDIENTE: full address, Spain], contact . Using the site means you accept these terms. Spanish law applies, in particular Law 34/2002 (LSSI-CE) and the consumer legislation in Royal Legislative Decree 1/2007.
2. This is a game
MOFOBURN is entertainment. You add fuel to a project and its position on the board depends on how much of that fuel is left. Visitors burn it by voting. You are buying a chance to stay visible, not a position.
Fuel is internal credit. It is not money, it has no monetary value, it cannot be exchanged, transferred or redeemed for anything, and it is not refundable — with the single exception in section 4. It is not an investment, a deposit, advertising inventory or a financial product. There are no prizes of any kind. Nothing you do here can pay you anything.
Do not add fuel you are not willing to lose entirely.
3. Fuel, burning and lives
- Fuel is added in a single payment. There are no subscriptions.
- A project can take at most $100 of fuel per life. When its balance reaches zero that life ends and its figures are frozen. Adding fuel afterwards starts a new life, with counters at zero and its own $100 ceiling.
- Each downvote burns $1 of the balance. Each upvote returns $1 to it, never above what was added.
- The five projects at the top pay $0.50 an hour for the position.
- At $0 the project leaves the board and its life becomes a headstone in the graveyard.
- Free projects hold no fuel, never burn, and never rank above a project that does.
Because the service is delivered immediately and consists of digital content, by paying you expressly request immediate performance and acknowledge that you lose the 14-day right of withdrawal once the fuel is credited, under article 103(m) of Royal Legislative Decree 1/2007.
4. Removal, and what happens to the balance
We may remove any content, at any time, without prior notice, at our sole discretion and with no appeal. Two different rules apply to whatever balance is left:
- Removed for breaking these terms: nothing is returned. Returning it would reward the breach, and the card used may not belong to the person who used it.
- Removed on our own initiative, with no breach on your part: the unspent balance is returned to the original payment method.
If you take your own project down, the unspent balance is forfeited. Someone who proves they control a project's domain can have that project removed, whoever published it.
A removed project is shown publicly as REMOVED, with no reason given. We do not publish accusations against a named site.
5. Position means nothing
A project's position on the board is not a rating, a review, an endorsement or a recommendation. It reflects how much fuel that project has left, nothing else. Links to third-party sites are marked nofollow and we do not check, verify or vouch for anything they contain. Position cannot be bought directly: there are no sponsored slots and no paid placements.
6. What you may publish
You must have the right to publish what you submit, and you must be able to receive email at the address you give us: unconfirmed projects stop being shown after 24 hours. One URL may have one active project, and one address may have three.
None of the following is allowed:
- anything illegal under Spanish or EU law
- pornography
- malware, phishing, or anything designed to deceive a visitor into harm
- scams, fraudulent offers and fake products
- real-money gambling
- hate speech and harassment
- impersonating a person or an organisation
- third-party brands that are not yours. Publishing someone else's product, company or site is not allowed, whatever your reason
Reports are an inbox, not a verdict: we read them and decide by hand, at our discretion. You are responsible for what you publish; we are an intermediary hosting service under the LSSI-CE and the Digital Services Act.
7. Voting
One vote per person per project every 24 hours. Automated voting, vote manipulation, using multiple identities or attempting to drain a project through coordinated action is a breach of these terms and may result in removal without refund. We apply anti-abuse limits, including an hourly cap on how much a single project can lose.
8. No warranty, limited liability
The service is provided as is, without any warranty of availability, accuracy or fitness for purpose. To the maximum extent permitted by law, and except in cases of wilful misconduct or gross negligence, our total liability towards you is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing in these terms limits rights that consumers have under mandatory Spanish law.
9. Changes, law and disputes
We may update these terms; the version published here applies. Spanish law governs. Consumers may bring proceedings in the courts of their place of residence and may use the European Commission ODR platform at ec.europa.eu/consumers/odr. For anything else, the courts of [PENDIENTE: city], Spain.
